Terms of Service

1. Agreement to these terms
By using Locavisor (“the service”) you agree to these Terms of Service (“Terms”). If you do not agree, do not use the service. These Terms form a binding agreement between you and Locavisor (“we”, “us”).
2. What Locavisor is
Locavisor is an AI-assisted site-selection research tool. You give us a city, business type, and budget, and we produce a written report scoring nearby neighborhoods across five dimensions (demand, competition fit, rent fit, accessibility, customer match) using data from Google Places, U.S. Census, brokerage market reports, and other public datasets. The free preview shows your top three ranked neighborhoods; the $9.99 full report shows ten, with competitor analysis and an operating playbook per area.
Locavisor is research and decision support. It is NOT:
- A substitute for a licensed commercial real-estate broker.
- Legal, financial, or tax advice.
- A guarantee that a business opened in any recommended area will succeed.
- An endorsement of any specific property, lease, or competitor.
3. Payment and refund
The full report costs $9.99, charged once via Stripe Checkout. Prices are in USD and do not include tax, which is added at checkout where applicable.
Refund policy. If the full report fails to generate, arrives materially incomplete, or contains demonstrable factual errors about the data we claim to provide (e.g., listing a competitor that does not exist), email support@locavisor.app within 14 days of purchase with your Stripe receipt and we will issue a full refund. Because reports are delivered digitally and can be saved or shared immediately, we do not offer refunds for change-of-mind requests after a successful delivery. Refund disputes that cannot be resolved via email are handled per Stripe's dispute process.
4. Permitted use
You may:
- Use reports you paid for to evaluate, share with, or discuss locations with your co-founders, employees, landlords, brokers, lenders, and advisors.
- Export and quote sections of your own report.
- Access reports you paid for via your access link indefinitely (see our retention policy).
5. Prohibited use
You may not:
- Scrape, bulk-download, or reverse-engineer the service or any underlying data endpoints.
- Resell reports as a standalone product or service (this is a single-business tool, not a data reseller).
- Use the service to produce reports for areas outside of the scope we actively cover (you are welcome to try; we cannot guarantee quality).
- Use the service to defame, harass, or make false claims about identified competitor businesses.
- Attempt to bypass authentication, rate limits, or payment gates.
- Violate the terms of service of any third-party data provider we rely on.
We reserve the right to block accounts, IP addresses, or payment instruments that engage in the prohibited uses above, and to void reports obtained through fraud or abuse.
6. Data accuracy and freshness
We cite only data that comes from real sources (Google Places, U.S. Census, brokerage reports, etc.) and surface a confidence level per claim. However:
- Third-party data can be stale. A competitor Google listed yesterday may close today; an ACS demographic estimate has a margin of error.
- The AI-written prose is grounded in structured inputs but is generated text; we cannot guarantee every sentence is perfectly calibrated to your exact situation.
- Rent figures are from broker reports and public indexes, not from live lease quotes. Actual lease terms are negotiated with landlords and vary.
Always walk the corridor, talk to a broker, and verify anything material before signing a lease.
7. Intellectual property
- Your inputs (concept, customization notes) remain yours. You grant us a limited license to use those inputs to generate your report and to improve the service in aggregate (e.g., knowing which customization fields users actually use).
- Our report outputs are licensed to you for your own business decision-making. You may share, quote, or distribute them within the normal scope of running your business. You may not strip attribution and sell them as a standalone product.
- Third-party data cited in reports (Google Places listings, U.S. Census statistics, broker report excerpts) belongs to its original owners; its appearance in your report is under their respective terms.
8. Service availability
We run on modern cloud infrastructure but do not guarantee 100% uptime. Scheduled maintenance, third-party outages (Anthropic, Stripe, Google, Neon, etc.), or emergency fixes may make the service temporarily unavailable. Paid reports remain accessible after you load them once — we cache them to tolerate short outages.
9. Warranty disclaimer
The service is provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or accuracy.
We do not warrant that the service will be uninterrupted, error-free, or that any specific business outcome will result from following the guidance in a report.
10. Limitation of liability
To the maximum extent permitted by law, Locavisor's aggregate liability for any claim arising from your use of the service is limited to the amount you paid us in the twelve months preceding the claim (for most users, this will be $9.99 or $0).
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost business opportunity, or the consequences of a leasing decision influenced by a Locavisor report.
11. Indemnification
You agree to indemnify and hold Locavisor harmless from any third-party claims arising from (a) your use of the service in violation of these Terms, (b) content you submit through the customization form, or (c) your business activities taken in connection with a Locavisor report.
12. Termination
You may stop using the service at any time. We may suspend or terminate access for users who materially violate these Terms (e.g., scraping, abuse, chargeback fraud). Termination does not entitle you to a refund of reports already delivered, except as described in Section 3.
13. Changes to these terms
We may update these Terms as the service evolves. Material changes will be notified via email to users with active paid reports. The “Last updated” date above will reflect the latest version. Continued use of the service after an update constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the service will be brought in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
